What are the different title types?
- Torrens Title: This is the most common and secure form of land title. It provides a state-guaranteed title system, where ownership and other interests in the land are recorded in a central register maintained by the state or territory government. It offers clear and indefeasible ownership rights.
- Strata Title: This type of title is mainly applicable to multi-unit buildings or townhouses. It allows individual ownership of a specific unit or apartment within a building, along with shared ownership of common areas like hallways, gardens, and facilities.
- Community Title: Community title applies to developments with common property and shared facilities, such as gated communities or residential complexes. It allows individual ownership of land or dwellings along with shared ownership of communal areas.
Other title types that are less common in the House and Land industry.
- Old System Title: This type of title dates back to the colonial era, and its ownership is proven through a chain of historical documents. Old System Titles may have less secure ownership rights compared to Torrens Titles.
- Crown Lease: Land under Crown lease is typically owned by the government and leased to individuals or organizations for specific purposes, such as residential, commercial, or agricultural use.
- Qualified Title: This type of title may have some limitations or conditions associated with it, such as restrictions on development or usage.
- Indigenous Land Rights: In some cases, certain areas of land in Australia may be governed by specific Indigenous Land Rights laws, recognizing the land rights and interests of Aboriginal and Torres Strait Islander peoples.
