When is a build contract considered unconditional?

In Australian house and land sales, a build contract is considered unconditional when all contingencies or conditions in the contract have been met, waived, or expired—similar to a land contract. At that point, both parties are legally bound to proceed with construction.

Common Conditions in a Build Contract

  1. Finance Approval
    • The buyer must obtain formal construction finance approval (often after the land becomes unconditional or registers).

      Land Ownership or Settlement
